Terms of Service
Last updated: October 10, 2026
These terms are an agreement between you and Trade Titus. They cover this site, founders.tradetitus.com, and the founder packages and contributions bought on it. By using the site, posting a comment, or purchasing a founder package, you agree to the terms herein and to our Privacy Policy.
1. Definitions
In these Terms of Service (the “Terms”):
1.1 “Company,” “Trade Titus,” “we,” “us,” and “our” mean Contractor Gorilla, LLC, a Texas limited liability company doing business as Trade Titus.
1.2 “Site” means the website located at founders.tradetitus.com, including all of its pages, forms, and features, and all emails the Company sends in connection with it.
1.3 “Platform” means the Trade Titus software platform and related services under development by the Company.
1.4 “Beta” means the initial release of the Platform to Founders.
1.5 “Founder Package” means any founder package offered on the Site, currently Founder Access, Founder 12, Founder 24, and Founder Lifetime, and “Founder” means a purchaser of a Founder Package.
1.6 “Founding Payment” means the amount paid for a Founder Package.
1.7 “Contribution” means a payment made through the Site to support the Company that does not purchase a Founder Package.
1.8 “Onboarding” means the date on which the Company activates a Founder’s access to the Platform after the Beta launches, and “Onboarded” has a corresponding meaning.
1.9 “Standard Rate” means the Company’s standard monthly subscription price for the Platform, currently $499 per month.
1.10 “User Content” means comments, messages, answers, and any other material you submit through the Site.
1.11 “You” and “your” mean the individual using the Site and, where that individual acts on behalf of a business, that business.
2. Acceptance and Eligibility
2.1 Acceptance. By accessing or using the Site, submitting User Content, purchasing a Founder Package, or making a Contribution, you agree to be bound by these Terms and by the Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you may not use the Site.
2.2 Eligibility. You must be at least 18 years of age and legally able to enter into a binding contract to purchase a Founder Package, make a Contribution, or submit User Content.
2.3 Authority. If you use the Site on behalf of a business, you represent and warrant that you are authorized to bind that business to these Terms.
2.4 Accurate Information. You agree to provide accurate, current, and complete information when using the Site, including at checkout, and to update it as necessary.
3. Development Status of the Platform
3.1 The Platform is under development and is not currently available for use. Descriptions of features, integrations, capabilities, timelines, and the roadmap on the Site reflect the Company’s current plans and are subject to change without notice.
3.2 The Company does not guarantee that the Beta, the Platform, or any feature will be released on any particular date, in any particular form, or at all.
4. Founder Packages
4.1 Benefits. Each Founder Package includes: (a) guaranteed access to the Beta; (b) hands-on concierge onboarding, with priority over customers who are not Founders; (c) a direct line of communication with the Trade Titus team, including build updates; and (d) the founder rate applicable to the Founder Package purchased.
4.2 Credit. The full Founding Payment will be credited, as a dollar amount, toward your subscription fees for the Platform when the Beta starts.
4.3 Billing. Monthly subscription billing begins upon your Onboarding and not before. Beta access is billed at your founder rate. Your subscription will be governed by subscription terms the Company provides to you before Onboarding (the “Subscription Terms”).
4.4 Founder Rates and Rate Locks. (a) Founder Access: $199 for the first month after Onboarding, and the Standard Rate thereafter, with no rate lock. (b) Founder 12: the founder rate is locked for 12 months from Onboarding. (c) Founder 24: the founder rate is locked for 24 months from Onboarding. (d) Founder Lifetime: the founder rate is locked for so long as your subscription remains active. Upon expiration of a rate lock, your subscription will be billed at the Standard Rate then in effect.
4.5 One Location. Each Founder Package covers one business location with its own physical address. Each additional location requires a separate Founder Package.
4.6 Availability. Founder Packages are offered in limited quantities. Seat counts shown on the Site are for information only. The Company may change the number of seats offered at any time without affecting Founder Packages already purchased, and may decline or cancel any order in its discretion, in which case it will refund the Founding Payment in full.
4.7 Prices and Taxes. All prices are stated in United States dollars and exclude any applicable taxes, which are your responsibility.
4.8 No Partnership or Ownership. The terms “founding partner” and “founder” are designations for the Company’s early customers. They do not create any partnership, joint venture, employment, agency, or fiduciary relationship, and do not confer any ownership, equity, investment, profit-sharing, or governance interest in the Company or in Contractor Gorilla, LLC.
4.9 Transfer. A Founder Package may not be sold, assigned, or transferred without the Company’s prior written consent.
5. Refunds
5.1 Before Onboarding. Founding Payments are fully refundable, without condition, upon your request at any time before your Onboarding. To request a refund, reply to your purchase confirmation email or contact the Company at team@tradetitus.com. Refunds are issued to the original payment method; the time for a refund to appear depends on your card issuer and is typically 5 to 10 business days.
5.2 After Onboarding. After your Onboarding, refunds are governed by the Subscription Terms.
5.3 Effect of Refund. Upon a refund of your Founding Payment, your Founder Package and all of its benefits terminate.
6. Contributions
6.1 Contributions are voluntary, final, and non-refundable, except as required by law. A Contribution does not include a Beta seat, a founder rate, a Founder Package, or any goods, services, equity, or other rights. Contributors will receive a thank-you from the Trade Titus team and product updates. The minimum Contribution is $5.
6.2 The Company is a for-profit company. Contributions are not charitable donations and are not deductible as charitable contributions.
7. Payments
7.1 Payment Processing. Payments are processed by Stripe, Inc., and are subject to Stripe’s terms of service. The Company does not receive or store full payment card numbers.
7.2 Statement Descriptor. Charges appear on your card statement as TRADE TITUS.
7.3 Billing Disputes. If a charge looks wrong, please contact us first, so we can review it and correct it, if needed. If you initiate a chargeback or payment dispute, the Company may provide your card issuer with records of the transaction, including your acceptance of these Terms, and may suspend the related Founder Package until the dispute is resolved.
8. User Content
8.1 License. You retain ownership of your User Content. You grant the Company a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, display, publish, distribute, adapt, and store your User Content, together with your first name, in connection with operating and promoting the Site, the Platform, and the Company.
8.2 Your Representations. You represent and warrant that you own or have all necessary rights to your User Content, and that your User Content and the Company’s use of it as permitted by these Terms do not violate any law or infringe or violate any right of any third party.
8.3 Moderation. The Company may review, approve, decline, hide, or remove any User Content at any time, in its sole discretion, and has no obligation to display any User Content. Approved comments are displayed with the commenter’s first name, the comment, its date, and, where applicable, a Founder badge; company names and email addresses are not displayed.
8.4 No Endorsement. User Content reflects the views of its author and not those of the Company.
9. Intellectual Property
9.1 Ownership. The Site and all of its content, features, and functionality, including all text, graphics, logos, images, photographs, video, audio, software, code, designs, layouts, look and feel, and the selection and arrangement of all of the foregoing (collectively, the “Company Content”), are owned by the Company or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. All rights are reserved.
9.2 No License. Except for the limited right to view the Site in a web browser for your own evaluation of the Platform, no right or license is granted to you in or to any Company Content. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, frame, scrape, or otherwise use any Company Content, in whole or in part, without the Company’s prior written consent.
9.3 Trademarks. The Trade Titus name, logo, and related marks are trademarks of the Company and may not be used without the Company’s prior written consent.
9.4 Third-Party Marks. The names and logos of AI assistants and other companies shown on the Site are the property of their respective owners. Their display does not imply any affiliation with, endorsement by, or partnership with those companies.
9.5 Feedback. Any ideas, suggestions, or feedback you provide about the Site or the Platform may be used by the Company for any purpose without obligation or compensation to you.
10. Prohibited Conduct
You agree not to:
- (a) violate any applicable law or regulation, or infringe or violate any right of any person;
- (b) provide false or misleading information or impersonate any person or entity;
- (c) post or transmit any content that is unlawful, defamatory, obscene, harassing, threatening, abusive, invasive of privacy, or otherwise objectionable;
- (d) send unsolicited advertising, promotional material, or spam through the Site;
- (e) upload or transmit viruses, malware, or any code designed to harm or interfere with the Site or any device;
- (f) attempt to gain unauthorized access to the Site, its systems, or any data, or circumvent any security measure;
- (g) interfere with or disrupt the Site, or impose an unreasonable load on its infrastructure;
- (h) use any robot, scraper, or other automated means to access, copy, or submit content to the Site, other than search engines indexing the Site’s public pages; or
- (i) reverse engineer, decompile, or disassemble any part of the Site.
11. Copyright Complaints
If you believe material on the Site infringes your copyright, send a written notice to team@tradetitus.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and its location on the Site; (d) your name, address, telephone number, and email address; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf. The Company will review valid notices and remove infringing material.
12. Third-Party Services
The Site contains links to, and relies on, third-party websites and services, including Stripe’s checkout. The Company does not control and is not responsible for any third-party website or service, and your use of it is subject to that third party’s own terms and policies.
13. Company Rights; Suspension and Termination
The Company may, at any time and in its sole discretion: (a) modify, suspend, or discontinue any part of the Site; (b) decline or cancel any order, with a full refund of any amount paid for it; (c) remove any User Content; (d) verify the identity and information of any purchaser where it suspects fraud or misuse; and (e) suspend or terminate your access to the Site for any violation of these Terms. Sections 6 through 9 and 11 through 21 survive any termination.
14. Disclaimers
THE SITE, THE FOUNDER PACKAGES, AND ALL INFORMATION AND CONTENT ON THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXCEPT AS EXPRESSLY STATED IN THESE TERMS. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
NO PERSON CAN GUARANTEE WHAT AN AI ASSISTANT WILL RECOMMEND. THE COMPANY DOES NOT WARRANT OR GUARANTEE ANY RECOMMENDATION, RANKING, VISIBILITY, NUMBER OF LEADS, BOOKINGS, REVENUE, OR OTHER RESULT FROM THE PLATFORM OR THE SITE.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO THE SITE, A FOUNDER PACKAGE, A CONTRIBUTION, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPANY’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, A FOUNDER PACKAGE, A CONTRIBUTION, OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
16. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: (a) your User Content; (b) your use or misuse of the Site; or (c) your violation of these Terms or of any law or right of any third party.
17. Dispute Resolution; Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AND WAIVES THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
17.1 Informal Resolution. Before commencing any arbitration or court proceeding, the party raising a dispute must send the other party a written notice describing the dispute and the relief sought; notices to the Company must be sent to team@tradetitus.com. The parties will attempt in good faith to resolve the dispute informally for sixty (60) days after the notice is received.
17.2 Agreement to Arbitrate. Except as provided in Section 17.5, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, a Founder Package, or a Contribution, including the validity, scope, or enforceability of this Section 17, will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable rules then in effect, before a single arbitrator. The arbitration will be seated in Williamson County, Texas, and may be conducted by telephone or videoconference if the arbitrator permits. Fees and costs of the arbitration will be allocated as provided in the AAA’s rules. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction. This Section 17 is governed by the Federal Arbitration Act.
17.3 Class Action Waiver. YOU AND THE COMPANY MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate the claims of more than one person or preside over any form of class, collective, or representative proceeding.
17.4 Jury Trial Waiver. YOU AND THE COMPANY EACH WAIVE ANY RIGHT TO A TRIAL BY JURY.
17.5 Exceptions. Either party may (a) bring an individual claim in a small claims court of competent jurisdiction, or (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of its intellectual property or misuse of the Site.
17.6 Severability. If the class action waiver in Section 17.3 is found unenforceable as to any claim, that claim will be severed and decided by a court under Section 18, and the remainder of this Section 17 will remain in effect. This Section 17 survives any termination of these Terms.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Texas and applicable federal law of the United States, without regard to conflict-of-law principles. Subject to Section 17, any action permitted to proceed in court must be brought exclusively in the state or federal courts located in Williamson County, Texas, and you and the Company consent to the personal jurisdiction of those courts.
19. Changes to These Terms
The Company may amend these Terms at any time by posting the amended Terms on the Site and updating the “Last updated” date. Amended Terms take effect when posted, and your continued use of the Site after that constitutes acceptance of them. No amendment will reduce the benefits of a Founder Package purchased before the amendment takes effect.
20. Electronic Communications
You consent to receive communications from the Company electronically, including by email and through the Site, and agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that they be in writing.
21. General
21.1 Entire Agreement. These Terms, together with the Privacy Policy and, after Onboarding, the Subscription Terms, constitute the entire agreement between you and the Company regarding their subject matter and supersede all prior agreements and understandings.
21.2 Severability. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
21.3 No Waiver. The Company’s failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
21.4 Assignment. You may not assign or transfer these Terms or any rights under them without the Company’s prior written consent. The Company may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
21.5 Force Majeure. The Company is not liable for any delay or failure to perform caused by events beyond its reasonable control.
21.6 No Third-Party Beneficiaries. These Terms do not confer any rights on any third party.
21.7 Headings. Section headings are for convenience only and do not affect interpretation.
22. Contact
Questions about these Terms may be sent to team@tradetitus.com or submitted through the Contact page.
